候选人保密及禁止绕过协议 Candidate Confidentiality & Non-Circumvention Agreement
本协议由 Australian Career Pathways（ACP） 与下列候选人（“候选人”）签订。
This Agreement is between Australian Career Pathways (ACP) and the candidate identified below (“Candidate”).
1. 保密信息。保密信息包括但不限于：ACP在招聘及签证担保过程中向候选人披露的职位信息、雇主信息、薪资及费用信息、签证担保流程细节及其他商业信息。
Confidential Information includes, without limitation, job details, employer details, salary and fee information, visa sponsorship process details, and other business information disclosed by ACP to the Candidate.
2. 保密义务。候选人同意对所有保密信息严格保密，未经ACP事先书面同意，不得向任何第三方（包括其他中介机构）披露。
The Candidate agrees to keep all Confidential Information strictly confidential and will not disclose it to any third party (including other agencies) without ACP’s prior written consent.
3. 禁止绕过条款。候选人同意，在本协议签署之日起12个月内，不得以绕过 ACP 服务为目的，直接或间接联系、申请或与 ACP 介绍的任何雇主达成协议。
The Candidate agrees not to directly or indirectly contact, apply to, or reach an agreement with any employer introduced by ACP, for the purpose of circumventing ACP’s service, for 12 months from the date of this Agreement.
4. 无保证声明。签署本协议并不保证候选人将获得工作机会、签证批准或成功安置。ACP 将本着诚信原则协助候选人完成相关流程。
Signing this Agreement does not guarantee the Candidate will receive a job offer, visa approval, or successful placement. ACP will act in good faith to assist the Candidate through the relevant process.
5. 有效期。本协议自签署之日起生效，禁止绕过条款持续 12 个月。
This Agreement is effective from the date of signing; the non-circumvention clause remains in effect for 12 months.
6. 适用法律。本协议受澳大利亚昆士兰州法律管辖。
This Agreement is governed by the laws of Queensland, Australia.
